Safety information and resources for Australian Users
The Online Safety Act 2021 (Cth) is Australian legislation which aims to improve and promote online safety for Australians.
The Online Safety Act establishes the eSafety Commissioner. The eSafety Commissioner is Australia’s independent regulator and has the role of promoting online safety by administering the Online Safety Act.
The functions of the eSafety Commissioner
The functions of the eSafety Commissioner are set out in section 27 of the Online Safety Act and include:
- promoting online safety for Australians;
- supporting and encouraging the implementation of measures to improve online safety for Australians;
- coordinating activities of Commonwealth Departments, authorities and agencies relating to online safety for Australians;
- collecting, analysing, interpreting and disseminating information relating to online safety for Australians;
- supporting, encouraging, conducting, accrediting and evaluating educational, promotional and community awareness programs that are relevant to online safety for Australians;
- making, on behalf of the Commonwealth, grants of financial assistance in relation to online safety for Australians;
- supporting, encouraging, conducting and evaluating research about online safety for Australians;
- publishing (whether on the internet or otherwise) reports and papers relating to online safety for Australians;
- giving the Minister reports about online safety for Australians;
- advising the Minister about online safety for Australians;
- consulting and cooperating with other persons, organisations and governments on online safety for Australians;
- advising and assisting persons in relation to their obligations under the Act;
- monitoring and promoting compliance with the Online Safety Act;
- formulating, in writing, and promoting guidelines or statements that:
- recommend best practices for persons and bodies involved in online safety for Australians;
- are directed towards facilitating the timely and appropriate resolution of incidents involving material provided on a social media service, relevant electronic service or designated internet service; and
- formulating, in writing, and promoting guidelines for the taking of reasonable steps to prevent age-restricted users having accounts with age-restricted social media platforms.
Referring a matter to the eSafety Commissioner
If you wish to refer a matter about Lightningware Inc. or the Thundr service to the eSafety Commissioner, you may do so on the eSafety Commissioner's website: https://www.esafety.gov.au/industry/codes/complaints.
Before contacting the eSafety Commissioner, we encourage you to submit a complaint directly to Thundr so we can review and address the matter.
Reporting Class 1A or 1B material on Thundr
Thundr provides tools that allow users to report harmful content, including material that may fall within Class 1A or Class 1B categories under Australia's Online Safety Act.
Class 1A material includes child sexual abuse material, pro-terror material and extreme crime and violence. Class 1B material includes crime and violence and drug-related material.
If you encounter material of this nature on Thundr, please report it immediately.
Reporting Class 1A or 1B material on Thundr
- During a video chat, click on the report icon (red flag) located on the video feed. You will be able to select whether the report relates to Class 1A or Class 1B material.
- Once the report has been submitted, you will receive an automated message in the chat confirming that your report has been received and will be investigated. You will also be provided with a link to the "Complaints" page where you can submit a more detailed complaint.
- Our team will then review and/or investigate the report.
- Following review of the report, if the report relates to Class 1A or 1B material our team will provide you with an update about the status of the report, including the outcome of any investigation conducted and any action proposed to be taken by Thundr as a result of the report.
How to make a complaint to Thundr
If you wish to make a complaint to Thundr about Class 1A or Class 1B on the service or about Thundr's compliance with the Relevant Electronic Services Standard, please submit a complaint through the Complaints page. The Complaints page provides a dedicated form and instructions for submitting a complaint.
Thundr will notify you about the outcome of an investigation and any action proposed to be taken by Thundr as a result of the complaint.
